(8:00) David Choate, owner of Dinkytown McDonald’s seeking to rebuild after sustaining damage during bridge repair. Because new free-standing fast food restaurants are not permitted in a Pedestrian Overlay District, a text amendment to the zoning code is suggested. (see below for text amendment)

Text Amendment to Zoning Code being proposed:
Off-street parking. Nonresidential uses shall not be required to provide accessory off-street parking facilities, provided that existing accessory parking facilities shall not be reduced below the requirements for a similar new use, or if existing accessory parking facilities are less than the requirements specified in Chapter 541, Off-Street Parking and Loading, they shall not be reduced further.
Fast Food restaurants with drive through facilities. Notwithstanding any provision to the contrary, any lawfully existing fast food restaurant with a drive-through facility shall have all the rights of a conforming use and may be rebuilt or replaced subject to the following, provided all other applicable requirements of this zoning ordinance are met: The restaurant shall be limited to a maximum floor area of six thousand (6,000) square feet
The restaurant and drive-through facility shall be located within the boundaries of the zoning lot existing on the effective date of this ordinance, except as otherwise approved by the city planning commission.
